How did this mess with the Supreme Court start? The man that actually started this mess was good old Mitch McConnell who many affectionately call Moscow Mitch. On February 13th 2016 Antonin Scalia died leaving an opening on the Supreme Court that, by the Constitution was suppose to be filled by the sitting President. That sitting President was Barak Obama. Mitch McConnell held up the appointment of the man the President Obama appointed, Merrick Garland, saying that he did not believe that a new Supreme Court Justice should be appointed during an election year. He said that the people need to have their say. That is nowhere in the Constitution. McConnell just made it up to obstruct then President Obama and the Democratic Party. He introduced party politics like it had never been before in the confirmation of a Supreme Court Justice. He didn’t hold any hearings. Nothing came to a vote. Mitch McConnell decided that he would do whatever he damn well pleased because he was the majority leader of the Senate. Obstruct, cheat, lie, he did it all. He weakened America and damaged our Democracy.

Because of Moscow Mitch Trump got to pick his first of three Supreme Court Justices. Neil Gorsuch was Trump’s first Supreme Court Justice. He was rammed down the public’s throat by the Republican Party. Of course there was not a lot of support or cooperation from the Democratic Party because, to be honest with you, he was not Trump’s Judge to pick. It should have been Obama’s. Trump said that he would unite the country but when you start your Presidency appointing a Supreme Court Justice that constitutionally was not yours to appoint, well let’s just say that it is not a good way to start out your presidency. The pick will forever be associated with Trump but the man that did the most to divide the Country was good old Moscow Mitch.

Trump got a second pick when in June of 2018 Justice Kennedy stepped down from the bench. This time Trump appointed Bret Kavanaugh. By this time there was no cooperation between the Republicans and the Democrats who were still fuming that Obama was denied his constitutional right to appoint Garland to the Court. The Kavanaugh hearings were nothing less than a circus and both parties are to blame for that. The Democrats probably would have attacked anyone that Trump appointed because they didn’t feel that they could trust Trump ever to do the right thing. One thing that was apparent was they didn’t trust Kavanaugh. Christine Blasey Ford came forward and said when Kavanaugh was 17 years old he sexually assaulted her which she described as an attempted rape. Ford’s allegations were followed by sexual assault claim by Yale classmate Deborah Ramirez and Julie Swetnick accusing Kavanaugh of gang rape in high school. Of course the all these allegations were never really investigated and we now probably have a sexual predator on the Supreme Court to go along “Long Dong Silver” Clarence Thomas. The women were demonized by the Republican Party and the conservative news. These women bravely came forward and were called liars paid by the Democrats. We as a nation witnessed why women do not come forward when assaulted. They are made out to be liars instead of the victims based on what they actually wear.

Trump got a third appointment when Ruth Bader Ginsburg died in September of 2020 just 2 months before the 2020 Presidential election. Now you have to go back to 2016 and remember that Mitch McConnell said that a Supreme Court justice should not be picked during an election year because the people should have a voice in the selection. Well, let’s just say that in 2016 not only did good old Moscow Mitch make that up but that he was actually lying. He rushed through Amy Barrett’s appointment even though he obstructed the Garland appointment. Moscow Mitch’s lying only divided and weakened us more.  Amy Barrett should have done the right thing and declined stating that by precedent, the appointment should be done after the election. Of course, I am now convinced that Republicans are not taught to do the right thing. Twelve days before the election Barrett was confirmed and sworn in.

Now we have Biden’s first appointment and of course Mitch McConnell is still obstructing the Democratic appointment to the Supreme Court. Ketanji Brown Jackson is the first Black Woman to ever be nominated to the highest court in the land and I think that her qualifications are impeccable. What we have witness by the Republicans has been downright racist but that is what we have come to expect from the Republicans in the Senate. We all witnessed the favoritism that the Kenosha Judge showed Kyle Rittenhouse and how all the Republicans hailed Rittenhouse victim of the left and a hero on the right. The Republicans have said the Jackson is soft on crime. After the Rittenhouse trial they have no right to say anyone is soft on crime. Two people died but that’s ok because a he was only shooting Black Lives Matter Protestors and their lives didn’t matter to Republicans. The racism has been very apparent in the questioning. Was Barrett asked about Critical Race Theory? Jackson was. We have a very qualified Black Women sitting in front of the Senate and being subjected to racial abuse and she has held her composure as the true professional that she is.

Now we have many people questioning the legitimacy of the Supreme Court and I am one of those. The Republican Party and the Democratic Party is not part of the Constitution. Our Constitution is not about party politics and the people whose job it is to interpret should not be tied to party politics. Unfortunately that is not true.  The Republicans have made it all about party politics. The Republicans have packed the courts with people that will be just an extension of the Republican Party and not people to protect the Constitution and the rights of all Americans. Our right to vote is under attack. The Court would not even hear the case of Gerrymandering that is really voter suppression. Women’s right should not be under attack by the religious right. They should be protecting the separation of church and state.  The Republic that the Supreme Court is suppose to protect is under attack from within and in some cases such as with Gerrymandering the Supreme Court has been a tool of the oppressor. Our courts shouldn’t have to be packed but as long as the Court is a tool of party politics and not the separate branch of the government that they are suppose to be it may be necessary.  Free of party politics is what we need from the Supreme Court. This country will continue to spiral down to a version of apartheid unless the Supreme Court begins to believe in the right s all Americans.

This is my continued search on whether Trump has the Character to be President. A person I know stated “His character matters bc it is in the character I believe he has the leadership, knowledge, wisdom, experience, compassion, integrity that will lead us on the path towards a more safe, secure, healthy, prosperous, free world than the direction we are headed.” My last blog looked at his character as integrity from a legal standpoint before he even was elected President. From a legal standpoint there is no way I would have thought he had the integrity to be President.   It is a new game but it is still being played just like the old one. Biden has chosen not to run for a 2 nd term and it looks like Kamala Harris will get the Democratic nomination. This drastically changes what the election will look like. Instead of two old white guys facing one another we will have a woman that is 19 years younger than the Republican nominee Donald Trump. Donald Trump went from saying Biden was too old and senile even though he was only three years younger than Biden to the old guy that appears to be too old and senile. Since Biden’s debate performance he had been under a considerable amount of pressure to drop out of the race. I have admitted in a past post when Biden came on stage he looked frail and in the beginning of the debate Trump’s tactics really confused Biden.
