Justice in America. I don’t understand justice in America and I don’t understand the two tier justice system that seems to be part of the justice system. What I see is a multi-tier justice system in this country. People with money seem to be able to delay justice and at times escape justice. They have the means to make the justice system work for them just like their money makes it so the government works for them.  A regular citizen does not have the means to appeal every decision that a judge makes but people with money do. I really think that our justice system is driven more by money than it is by the law.

We have seen how money has bought the Supreme Court. From guns to women’s privacy the Supreme Court has, in my opinion, not just misinterpreted, the Constitution it has created new laws. The rulings by the Conservative court have done a great deal of damage to the Country and are responsible for a lot of the mess that we are in. Our streets have been made more dangerous because how they ruled on the 2nd Amendment. There is no such thing as Constitutional carry in the 2nd Amendment. Go ahead and read it. Their ruling with Citizen’s United did not enhance free speech. Instead it has helped silence the truth with misinformation and lies. It also opened the floodgates to a whole lot of political corruption. Because of the Supreme Court, bribery is legal in Washington DC. They ruled that women didn’t have the right to privacy in healthcare. Privacy is an essential liberty that we went to war over. Our system was not set up for there to be two different courts, one conservative and one liberal. That is where the problems lie. The court was never meant to be a political organization. I know that it is hard not to believe but look at some of the past justices. Ronald Reagan is the hero of the conservative movement and the Republican Party. Reagan nominated Sandra Day O’Connor who was a great and fair Supreme Court Justice. The three Justices that Trump appointed all stated that Roe vs. Wade was the law of the land. In reality they all lied during their confirmation hearing. Lying is now part of the American fabric and the Supreme Court is no exception.

One decision that was made by the courts was made in Michigan stating that the State Attorney General does not that the right to keep Trump of the ballot. He states that it is up to Congress. The ruling by Judge James Roberts determined that arguments as to whether Trump should be barred based on the working within the 14th Amendment are “nonjusticiable” (is that even a word?), or outside the jurisdiction of the Court. Instead, he said that their political nature could only be decided by Congress. Here is the 14th Amendment “No person shall be a Senator or Representative in Congress, or elector of President and Vice President or hold any office, civil or military, under the United States, or under and State, who, having previously taken an oath, as a member of Congress, or as an office of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such a disability”. If you look at the 14th Amendment it does not say what he says it does. It is not about politics, our Constitution is not a political document. It is about Insurrection and it doesn’t use the words convicted of Insurrection. It does not say that it must be enacted by Congress it says just the opposite. It says that only Congress can allow an insurrectionist to be on the ballot. I believe that a State not only has the right to keep Trump off the ballot but it has the Constitutional responsibility to keep Trump off the ballot.

A temporary stay on the gag order for Trump’s civil proceedings in New York has been issued. Associate Justice David Friedman of the First Judicial Department ruled from the bench. In a written order, the judge said “considering the Constitutional and Statutory rights at issue an interim stay is granted”. Witness tampering is illegal. Threatening a judge is illegal. You can say the Trump is not threatening anyone but I think he knows what he is doing. He is intentionally trying to obstruct justice though intimidation using social media. It does not take a rocket scientist to know that is what Trump is doing. The average man or woman does not have the means to intimidate the court as Trump does. Trump wants that two tier justice system that his money gives him and the court is helping him. The average citizen would already be in jail for the offenses that Trump has committed. Our trials are argued in court and not on social media and he is using social media to intimidate and manipulate the public. There are examples to people that were denied bail doing the same thing that Trump has done which is stolen classified documents and then shared that information. Jack Teixeira was held without bond for sharing classified documents on line. Trump should not have been treated differently.

Yes, there is a multi-tiered system in America and that it does not favor the poor or minorities. We need a justice system that upholds the law and not one that is used to hide behind it. We don’t need a conservative or a liberal system; we need a system that searches for the truth. Trump should not be treated any different than George Floyd. Not that a cop should be kneeling on Trump’s neck until he suffocates but a system that treats them equally before the law. That is not happening today but it should. Trump’s right to free speech should be no greater than any of ours. I will always say that the lies and misinformation that is spread by social media weakens our nation. When people use social media to try and intimidate our justice system or intimidate witnesses the whole Country gets weaker because of it.
